These Terms of Use (“Terms”) govern your access to and use of the NCIEM.us website, mobile applications, and services provided through our platform (collectively, the “Services”). By using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing, registering, or using our Services, you agree to these Terms and all referenced documents. If you do not agree, do not use the Services.

2. Changes to Terms

We may update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

3. Eligibility

You may use the Services only if you are of legal age and capable of entering into binding contracts. By using the Services, you confirm that you meet these requirements.

4. Account Registration and Security

4.1 You must provide accurate, current, and complete information when creating an account and keep it updated.
4.2 You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of unauthorized access.

5. User Responsibilities and Conduct

5.1 You agree to:

• Use the Services in compliance with all applicable laws.

• Cooperate with any compliance or identity checks.

5.2 You must not:

• Upload illegal, harmful, or infringing content.
• Sell prohibited or restricted items (weapons, drugs, counterfeit goods, hazardous chemicals).
• Engage in fraud or manipulation.
• Interfere with the Services or reverse-engineer any system.

6. Intellectual Property

All content, trademarks, logos, and materials are owned by NCIEM or licensed to us. Unauthorized copying or distribution is prohibited.

7. Product Information and Warranties

Product information is provided by manufacturers or sellers. Accuracy is not guaranteed. Manufacturer warranties apply unless otherwise stated.

8. Limitation of Liability  

To the fullest extent permitted by law, NCIEM is not liable for:

• Indirect, incidental, or consequential damages
• Loss of business, data, or revenue
• Errors, delays, or service interruptions

Our maximum liability shall not exceed the amount you paid to NCIEM in the last 12 months (or $100 if no payment was made).

9. Indemnification

You agree to indemnify NCIEM against claims, liabilities, or damages arising from your use of the Services or violation of these Terms.

10. Suspension and Termination

We may suspend or terminate access for violations, fraud, or legal requirements. Upon termination, all rights to use the Services cease immediately.

11. Warranties

Products are covered by manufacturer warranties unless explicitly stated. NCIEM does not provide independent warranties.

12. General Provisions

12.1 These Terms constitute the entire agreement between you and NCIEM.
12.2 If any provision is invalid, the rest remains enforceable.
12.3 Failure to enforce rights does not waive them.
12.4 You may not assign rights without written consent.
12.5 Refer to our website policies for shipping, returns, and operational rules.

13. Governing Law and Dispute Resolution

These Terms are governed by U.S. law. Disputes shall be handled by the federal or state courts in Georgia unless otherwise required by law.
